DISTANCE AGREEMENT
1. General Provisions
1.1. This agreement is concluded between the owner of the online store www.omamma.lv, self-employed person Melita Klubure (registration No. 29116210130, legal address: Biķernieku iela 109A-20, Riga, LV-1039, Latvia, e-mail: [email protected], hereinafter – Seller), and the person placing an order and making a purchase on the www.omamma.lv website (hereinafter – Buyer).
2. Ordering and Payment Procedure
2.1. The Buyer places an order by filling out the relevant order form on the Seller's website www.omamma.lv.
2.2. When placing an order, the Buyer undertakes to provide accurate information. The Buyer agrees to inform the Seller of any changes no later than 24 hours after receiving order confirmation by writing to: [email protected]. The Buyer is responsible for providing correct data; otherwise, delivery of the goods is not guaranteed.
2.3. The Buyer can choose from the following payment methods: • Non-cash payment (bank transfer) to the account specified in the invoice prior to receiving the goods; • Payment in person (in cash or by bank card) upon receiving the goods at the store "TEV", Čaka iela 22, Riga.
2.4. After placing an order, an electronically prepared invoice, valid without a signature, is sent to the e-mail address provided by the Buyer.
2.5. If delivery via parcel locker or post is selected, the goods are reserved until full payment is received (for no longer than 3 business days) and dispatched after the payment arrives in the Seller's account. If the invoice is not paid within the specified period, the order will be canceled.
3. Delivery and Pickup
3.1. The Buyer can choose delivery (parcel locker/courier/post) or pick up the goods free of charge in person at the store "TEV", Čaka iela 22, Riga, by prior arrangement of the pickup time.
3.2. If delivery is selected, it is processed after invoice payment and receipt of funds in the Seller's bank account. The average delivery time within Latvia is 1 to 3 business days. The Seller reserves the right to deliver goods within up to 2 calendar weeks if delivery times vary depending on stock availability.
3.3. Delivery to other countries is carried out according to the terms of the selected courier or postal service.
3.4. Orders can be placed 24 hours a day, but order processing is carried out on business days. Orders are not processed on Saturdays, Sundays, and public holidays.
3.5. The color of the product in the picture may differ slightly from the real product due to screen settings. If you have any questions before purchasing, please contact the Seller.
4. Right of Withdrawal and Returns
4.1. The Buyer has the right to withdraw from the purchased goods within 14 (fourteen) calendar days from the moment of receiving the goods by sending a written notice of withdrawal to the Seller at: [email protected].
4.2. Upon receiving the goods, the Buyer must make sure they correspond to the order.
4.3. The Buyer is obliged to return the goods to the Seller within 14 days after sending the notice of withdrawal. All expenses related to returning the goods to the Seller are covered by the Buyer.
4.4. The returned product must not be used or damaged. The Buyer is obliged to preserve the original condition and packaging of the product (if any) and retain shipping documents.
4.5. The right of withdrawal does not apply to goods made to the Buyer's individual order.
4.6. If the goods are packed incorrectly due to the Seller's fault, the Buyer has the right to exchange the goods within 14 days, and in this case, the return expenses are covered by the Seller.
5. Warranty and Liability
5.1. Warranty for purchased goods is provided in accordance with the Consumer Rights Protection Law of the Republic of Latvia.
5.2. The Seller is not liable for non-fulfillment of obligations if force majeure circumstances occur (non-fulfillment of obligations by third parties, state of emergency, climate anomalies, etc.).
6. Data Processing
6.1. By placing an order, the Buyer agrees to the processing of their personal data (name, surname, delivery address, phone number, e-mail) for order execution, delivery, and invoicing purposes.
6.2. The Seller undertakes not to disclose the Buyer's data to third parties, except for delivery services (courier/parcel locker operators) to ensure shipment delivery.
7. Final Provisions
7.1. Any disputes between the Seller and the Buyer shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the legislation of the Republic of Latvia.
7.2. The Seller reserves the right to amend these Terms at any time by publishing them on www.omamma.lv.
